Welcome to UC West Park (“we,” “us,” “our,” or “UC West Park”). These Terms & Conditions (“Terms”) govern your access to and use of our website located at https://ucwestpark.com/ (the “Site”), our parking reservation platform, and all related services (collectively, the “Services”).

By accessing or using our Site, creating an account, booking a parking space, or listing a property, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Services.

1. Overview of Services

UC West Park is an online marketplace that connects drivers looking for event and daily parking (“Drivers”) with property owners and landlords who have unused spaces available for monetization (“Landlords” or “Hosts”).

We facilitate pre-booked parking reservations, pricing optimizations, and digital payment processing.
We are a booking facilitator, not a traditional parking garage operator. We do not take custody, care, or control of your vehicle, nor do we insure vehicles or properties parked or listed through our platform.

2. Account Registration and Security

Eligibility: You must be at least 18 years of age and possess the legal authority to enter into a binding agreement to use our Services.
Account Information: You agree to provide accurate, current, and complete information during registration and to keep your account details updated.
Security: You are responsible for safeguarding your password and account credentials. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any losses arising from unauthorized account access.

3. Terms for Drivers (Parking Reservations)

Bookings: When you reserve a parking space through UC West Park, you enter into a direct agreement for space usage with the Landlord. UC West Park acts as an authorized payment collection agent for the Landlord.
Fees & Payment: You agree to pay all stated fees, including the parking rate, applicable taxes, and service fees at the time of booking.
Arrival & Compliance: You agree to arrive during your designated window, obey all instructions provided in your parking pass, park only within the assigned space, and respect property rules. Failure to do so may result in towing or revocation of parking privileges without a refund.
Vehicle Liability: UC West Park and the Landlord are not responsible for theft, vandalism, fire, or damage to your vehicle or its contents while parked at a designated space. Park at your own risk.

4. Terms for Landlords (Listing Spaces)

Property Ownership / Authorization: By listing a space on UC West Park, you represent and warrant that you are the legal owner of the property or have explicit, lawful authority from the owner to rent out the parking space.
Accuracy of Listings: You are responsible for providing accurate descriptions, clear photos, precise access instructions, and accurate availability schedules.
Pricing & Revenue: You may utilize our Price Optimization tools, but final listing rates are subject to your confirmation. You will receive your agreed-upon payout minus applicable platform commissions and processing fees.
Compliance with Local Laws: You are solely responsible for ensuring that renting out your space complies with local zoning laws, HOA rules, municipal ordinances, and tax obligations.

5. Cancellations and Refund Policy

Driver Cancellations: Cancellation windows and refund eligibility vary depending on the specific event and timing of the cancellation. Please check your booking details or submit a request via our “Request Refund” portal on the website.
Refund Requests: To request a refund, users must submit a refund form with valid payment details and a stated reason. Refunds are evaluated on a case-by-case basis.
Landlord Cancellations: If a Landlord cancels a confirmed booking due to unforeseen circumstances, Drivers will receive a full refund. Repeated cancellations by Landlords may result in penalties or account suspension.

6. Prohibited Conduct

When using the Services, you agree not to:

Violate any applicable local, state, national, or international law.
Circumvent or manipulate our fee structure, billing process, or platform fees.
Post false, inaccurate, misleading, or defamatory content, reviews, or listings.
Interfere with or disrupt the operation of the Site, servers, or networks connected to UC West Park.
Use any automated tool (such as bots, scrapers, or spiders) to access the Site without our express written permission.
Harass, threaten, or abuse other users, drivers, landlords, or support staff.

7. Intellectual Property Rights

All content, features, and functionality on the Site—including text, graphics, logos, icons, images, audio clips, and software code—are the exclusive property of UC West Park or its licensors and are protected by international copyright, trademark, and intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our explicit written consent.

8. Disclaimer of Warranties

YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. THE SERVICES AND ALL SPACES, LISTINGS, AND DATA ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. UC WEST PARK EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT PARKING SPACES WILL BE ACCESSIBLE OR FREE FROM DAMAGE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UC WEST PARK, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES—INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL—ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, PARKING INTERACTIONS, VEHICLE DAMAGE, OR PROPERTY LOSS, REGARDLESS OF THE THEORY OF LIABILITY.

10. Indemnification

You agree to defend, indemnify, and hold harmless UC West Park and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising out of or in any way connected with:

Your violation of these Terms.
Your use of a parking space (as a Driver) or the listing of a property (as a Landlord).
Your violation of any third-party right, including intellectual property or privacy rights.

11. Modifications to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. Any changes will be posted on this page with an updated “Last Updated” date. Your continued use of the Site following the posting of changes constitutes your acceptance of those changes.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which UC West Park operates, without regard to its conflict of law principles.
